Terms of Service

  1. Scope

    These Terms of Service, hereinafter referred to as "ToS", of NextExit Solutions GmbH, hereinafter referred to as "Provider", apply to all contractual relationships concluded by a consumer, hereinafter referred to as "User", in connection with the conduct of games on the Provider's premises. The masculine form of the term "User" also includes the female and diverse forms.

  2. Subject Matter of the Contract

    The subject matter of the contract is the conduct of games on the Provider's premises.

  3. Contracting Parties

    The NextExit Solutions GmbH is the Provider. "Users" within the meaning of these ToS may be private individuals who are not engaged in commercial trade, as well as companies and institutions that are considered part of commercial business. A minimum age of 12 years is required for participation. Booking requires legal age.

  4. Conclusion of Contract

    The published descriptions of the offers by the Provider do not represent binding offers by the Provider but serve as an invitation for the User to submit a binding offer.
    The User submits the offer in the form of the online order form, by telephone, or in person on the Provider's premises. The acceptance of the offer by the Provider takes place in the form of a written booking confirmation.
    A cancellation of the booking is possible up to 48 hours before the start of the game, unless explicitly agreed otherwise. A cancellation must be submitted in writing. If no valid cancellation is made, a refund is not possible.

  5. Contract Agreements

    The contractual agreements can be drawn up in German and English. Order processing and communication usually take place by email, telephone, or automated order processing.

  6. Remuneration

    The prices stated by the Provider are total prices and include statutory VAT. Payment processing is carried out via the payment service provider Mollie in accordance with its terms.

  7. Liability for Defects

    The statutory liability for defects applies.

  8. Applicable Law

    The law of the Federal Republic of Germany applies to all legal relationships of the parties. For consumers, this choice of law applies only insofar as it does not deprive them of the protection afforded by mandatory provisions of the law of the country in which the consumer has their habitual residence. The provisions of the UN Convention on Contracts for the International Sale of Goods do not apply.

  9. Place of Jurisdiction

    The place of jurisdiction is Straubing.

  10. Alternative Dispute Resolution

    We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
